    On 4 June 2026, a temporary banning order was made under section 73ZN(2)(a)(i) of the National Disability Insurance Scheme Act 2013 temporarily restricting/prohibiting Mr Boki Awi from being involved in the provision of supports or services to people with disability. Specifically, the order made prohibits Mr Boki Awi from being engaged in the following NDIS activities, supports or services:

    1. Provide or be involved in the provision, to any NDIS Participant, any support or services under a Participant’s Plan; and
    2. Provide or be involved or assist in the provision, to any NDIS Participant, any service or services under a Participant’s Plan.

    The banning order was made on the basis that a delegate of the Commissioner reasonably believes that:

    • Mr Boki Awi contravened section 73V of the NDIS Act, in connection with providing NDIS supports and services, by failing to ensure that supports and services are provided in a safe and competent manner, with care and skill as required under section 6(1) (c) of the NDIS Code of Conduct.

    This two (2) year banning order takes effect at 5:00pm AEDT on 22 June 2026 and operates across all States and Territories of Australia.

    On 1 June 2026, a banning order was made under subparagraph 73ZN(1)(b)(i) of the National Disability Insurance Scheme Act 2013 (NDIS Act) for contraventions of section 73V of the NDIS Act for failures to comply with paragraphs 6(1)(c), 6(1)(d) and 6(1)(f) of the NDIS Code of Conduct.  The banning order prohibits Kristy Louise Rabnott (Orpin) from providing supports and services to persons with disability in the National Disability Insurance Scheme (NDIS).     Participant’s Plan means a plan within the meaning of section 9 of the NDIS Act. 

    This order takes effect at 5.00pm AEST on 15 June 2026 and operates permanently across all States and Territories of Australia.

    On the 30 March 2026, a notice of revocation of registration was issued to Better Together Support Pty Ltd on the basis that a delegate of the Commissioner reasonably believes that Better Together Support Pty Ltd has contravened section 73J of the NDIS Act. More specifically, the failure by Better Together Support Pty Ltd in completing an assessment of the remaining elements of the Certification audit to be conducted three months after service delivery has commenced in any of the classes of support that require certification assessment.

The banning order permanently prohibits Alan MacDonald from being engaged in the following NDIS activities:

    3. Engaging in activities that would be undertaken by an auditor for an NDIS provider, to the extent that those activities relate to NDIS supports or services in the registered or unregistered market.

    • ‘Key personnel’ has the same meaning as set out under section 11A of the NDIS Act 

    • ‘Specified supports’ has the same meaning as set out under section 5 of the National Disability Insurance Scheme (Practice Standards—Worker Screening) Rules 2018

    The suspension was issued on the basis that a delegate of the Commissioner reasonably believes that Harbour Ability Pty Ltd contravened conditions of registration under sections 73F(2)(b) (conditions of registration under the NDIS Code of Conduct) and 73F(2)(c) (conditions of registration under the NDIS Practice Standards).
