Privacy Notice and Agreement for Participant and Provider Packs

Purpose 

This Privacy Collection Notice is for members of the public who opt-in to receive the NDIS Quality and Safeguards Commission (NDIS Commission, we or our) Participant or Provider packs. 

This notice explains how the NDIS Commission manages personal information in accordance with the Privacy Act 1988 (Cth) (Privacy Act) and should be read alongside our Privacy Policy and Privacy Statement.

Why is your personal information being collected? 

The NDIS Commission is collecting your personal information for the purpose of fulfilling your request to receive the Participant or Provider pack.   

We may also use your personal information to invite you to share feedback, provide updates about our resources and inform you about activities or the work of the NDIS Commission. 

What personal information is being collected? 

The NDIS Commission will collect your personal information, including your:  

  • first and last name
  • organisation or provider name
  • email address
  • postal address
  • contact telephone number
  • personal views or opinions

What happens if the NDIS Commission does not collect the personal information?  

If the NDIS Commission does not collect your personal information, we will be unable to send you the requested Provider or Participant pack.   

You can opt out at any time by contacting the Privacy Team at: privacy@ndiscommission.gov.au

How do we collect personal information?

The NDIS Commission will collect your personal information when you register to receive the Provider or Participant packs by using our online webform. 

If you express your interest in receiving a Provider or Participant pack, we may also collect your personal information by:

  • telephone
  • email
  • working groups or seminars.

Cookies  

The NDIS Commission may collect and use Cookies to maintain contact with you as a user of our website. A Cookie is a small file supplied by the NDIS Commission and stored by your web browser software on your computer when you access the NDIS Commission website. 

Who will the NDIS Commission disclose your personal information to?  

We may disclose your personal information to contracted service providers who assist the NDIS Commission with gathering data or emailing or posting the Participant or Provider packs.  

Personal information obtained by the NDIS Commission will only be used and disclosed for the purposes outlined above and will not be used or disclosed without your consent for any other purpose, except as authorised under the Privacy Act or where authorised or required by law, including by the National Disability Insurance Scheme Act 2013 (Cth) (NDIS Act).  

Overseas disclosure of your personal information  

The NDIS Commission does not usually disclose personal information to overseas parties. At times, the NDIS Commission website may contain links to other third-party websites outside the NDIS Commission. The NDIS Commission is not responsible for the privacy practices of third parties and encourages you to review these privacy policies to make your own decision about their privacy practices.  

How long will your personal information be kept? 

The NDIS Commission stores your personal information, in accordance with the Privacy Act and the Archives Act 1983 (Archives Act), to contact you and provide the requested Provider or Participant Pack until you withdraw consent. 

You can withdraw your consent at any time by contacting the NDIS Commission at: privacy@ndiscommission.gov.au 

Access and correct your personal information 

The NDIS Commission’s Privacy policy contains important information about how you can:

  • Access personal information we hold about you, and
  • Seek correction of personal information we hold about you.

Privacy complaints  

The NDIS Commission’s Privacy policy contains information about how you may complain about a breach of the Australian Privacy Principles (APP’s) and how the NDIS Commission will deal with complaints. Confirmation and consent 

By providing your personal information to register to receive the Provider or Participant pack, you consent to the NDIS Commission collecting and handling your personal information (including sensitive information) in accordance with this Privacy Collection Notice.
