Parliament passed NDIS Amendment (Securing the NDIS for Future Generations) Act 2026
The Australian Parliament passed the NDIS Amendment (Securing the NDIS for Future Generations) Bill 2026 on 19 August. Several measures in the legislation build on significant work already underway at the NDIS Commission to strengthen our regulatory approach and ability to prevent and reduce harm by holding providers and workers to account.
This includes:
- new offences for providing false or misleading information and intentionally destroying records to defraud the NDIS
- new offences for providers offering kickbacks and inducements
- stronger protections for whistleblowers who report wrongdoing.
The NDIS Commission will work closely across government, including the National Disability Insurance Agency (NDIA) and Department of Health, Disability and Ageing (DHDA) on several measures in the Act, such as provider definition changes, new fraud offences and plan management provider reforms.
The Bill has received Royal Assent and is now an Act of Parliament.
