Compliance and enforcement actions search

On 15 October 2025 a permanent banning order was made under sections 73ZN(1)(a), 73ZN(1)(b)(i) and 73ZN(1)(b)(iii) of the National Disability Insurance Scheme Act 2013. 

The banning order prohibits Ozihub Connect Pty Ltd (formerly Sunrise Aged Care and Disability Pty Ltd) from undertaking the following activities: 

1. engaging in activities that would be undertaken by a consultant for an NDIS provider, to the extent that those activities relate to NDIS supports or services; 

2. engaging in activities that would be undertaken by an auditor for an NDIS provider, to the extent that those activities relate to NDIS supports or services; 

3. engaging in activities in a non-service and non-support delivery role for an NDIS provider, to the extent that those activities have a direct effect on the provision of NDIS funded supports or service to people with disability in the NDIS; 

4. providing or being involved or assisting in the provision, to any NDIS participant, of any support or supports under a participant’s plan.

This Order takes effect on 31 October 2025 at 5:00pm AEDT and operates across all states and territories of Australia.

On 15 October 2025, a notice of revocation of registration was issued to Ozihub Connect Pty Ltd on the bases that a delegate of the NDIS Commissioner reasonably believes that:

• Ozihub Connect Pty Ltd has contravened, is contravening, or is proposing to contravene the National Disability Insurance Scheme Act 2013 (NDIS Act) (as provided for by section 73P(1)(a) of the NDIS Act)

• Ozihub Connect Pty Ltd is no longer suitable to provide supports of services to people with disability (as provided for by section 73P(1)(d) of the NDIS Act)

• the key personnel of the Ozihub Connect Pty Ltd are no longer suitable to be involved in the provision of supports or services for which Ozihub Connect Pty Ltd is registered to provide (as provided for by section 73P(1)(e) of the NDIS Act).

Ozihub Connect Pty was issued a suspension notice pursuant to Section 73N(1)(a)(i) of the National Disability Insurance Scheme Act 2013. Ozihub Connect Pty Ltd cannot operate as registered NDIS provider for a period of 30 days from 5.00pm AEST 12 September 2025 until 11 October 2025, including providing specialist behaviour support, specialist disability accommodation, plan management services, any class of support or service to a person whose NDIS plan is managed by the NDIA and implementing regulated restrictive practices. 

The suspension was issued on the basis that a delegate of the Commissioner reasonably believes that Ozihub Connect Pty Ltd has contravened, is contravening, or is proposing to contravene the NDIS Act. More specifically, it is alleged that,  Ozihub Connect Pty Ltd and its directors failed to comply with the the NDIS Code of Conduct and breached conditions of registration.

The alleged conduct presents ongoing and significant risks to the safety and wellbeing of people with disability, particularly in preventing NDIS participants from utilising their NDIS plan funds to access necessary and critical supports and services.
