Compliance and enforcement actions

On 1 July 2026, the banning order made on 13 April 2026 was varied under section 100 of the National Disability Insurance Scheme Act 2013 to temporarily prohibiting Simon James Nugus from engaging in the provision of NDIS supports and services to people with disability in the National Disability Insurance Scheme (NDIS), including:

1. Undertake employment in a position of key personnel of an NDIS Provider (registered or unregistered) where activities involve the management of NDIS Provider supports and services, or the administration under a Participant's Plan;
2. Engaging in activities involving the administration and management of funding for supports under a Participant's Plan;
3. Engaging in the provision of supports and services to Participants in connection with a Participant's Plan without the presence of another support worker or supervisor on duty;
4. Engaging in or be employed by consultancy services that provide the management of, or advice to NDIS Providers involved in the establishment of NDIS Provider Registrations, or the sale of established NDIS businesses;
5. Engaging in or be employed by an Approved Quality Auditor accredited under the NDIS Act 2013. 

NDIS Participant means a participant within the meaning of section 9 of the NDIS Act.

NDIS Provider means a NDIS Provider within the meaning of section 9 of the NDIS Act.

Participant’s Plan means a plan within the meaning of section 9 of the NDIS Act.

Key personnel means key personnel within the meaning of section 9 of the NDIS Act.

This banning order takes effect on 13 July 2026 at 5.00pm AEST for a period of three (3) years replacing the banning order issued on 13 April 2026 and operates across all States and Territories of Australia.
