Compliance and enforcement actions

On 6 December 2022, a compliance notice was issued to the Pacific Health and Wellness Pty Ltd (PHW) under section 73ZM of the National Disability Insurance Scheme Act 2013. The notice requires PHW to take certain action in order to address possible non-compliance by it with: 

• the National Disability Insurance Scheme (Incident Management and Reportable Incidents) Rules 2018, specifically: 
• the requirement to notify the Commissioner of reportable incidents within the prescribed timeframes; and
• the requirements of a registered NDIS provider’s incident management system.
