Compliance and enforcement actions

On 21 April 2023, a compliance notice was issued to My Ability Australia Pty Ltd under section 73ZM of the National Disability Insurance Scheme Act 2013. The notice requires My Ability Australia Pty Ltd to take certain action to address possible non-compliance by it with the National Disability Insurance Scheme (restrictive Practices and Behaviour Support) Rules 2018 (Behaviour Support Rules), specifically:

• Failing to ensure regulated restrictive practices are only used in accordance with a participant’s Behavioural Support Plan in contravention of Part 2, Division 2, section 10(2)(a) of the Behavioural Support Rules; and

Failing to ensure the use of regulated restrictive practices do not include restrictive practices prohibited by a State or Territory in contravention of Part 2, Division 2, section 8(2) of the Behavioural Support Rules.
