Compliance and enforcement actions

On 9 December 2025, NDIS Provider Circle of Hope Pty Ltd was issued with a compliance notice under section 73ZM(1)(b) of the National Disability Insurance Scheme Act 2013 (NDIS Act)

Circle of Hope Pty Ltd is required to take action to address potential non-compliance with regard to:

• Section 9 of the NDIS (Restrictive Practices and Behaviour Support) Rules 2018
• Section 21 of the NDIS (Incident Management and Reportable Incidents) Rules 2018
• Clause 10 of Schedule 1 of the NDIS (Provider Registration and Practice Standards) Rules 2018 - Risk Management
• Clause 6 of Schedule 4 – Module 2A of the NDIS (Provider Registration and Practice Standards) Rules 2018 - Implementing behaviour support plans
• Section 6(d) NDIS (Code of Conduct) Rules 2018 

The compliance notice was issued on the basis that a delegate of the Commissioner was aware of information that suggests that Circle of Hope Pty Ltd. may be contravening section 73J of the NDIS Act, by allegedly failing to comply with conditions of registration relating to: 

• authorisation of regulated restrictive practices;
• notification of reportable incidents;
• identification and management of risks for participants;
• implementation of behaviour support plans; and acting with integrity, honesty and transparency
