Compliance and enforcement actions

On 11 April 2024, a compliance notice was issued to Nulsen Group Ltd under section 73ZM of the National Disability Insurance Scheme Act 2013. The notice requires Nulsen Group Ltd to take certain action to address non-compliance with the National Disability Insurance Scheme (Restrictive Practices and Behaviour Support) Rules 2018, in relation to obligations to take all reasonable steps to facilitate the development of Behaviour Support Plans and obtain State or Territory authorisation as soon as reasonably practicable for the ongoing use of regulated restrictive practices with NDIS participants. The notice also requires Nulsen Group Ltd to take certain action to address non-compliance with the National Disability Insurance Scheme (Incident Management and Reportable Incident) Rules 2018, in relation to the obligation to notify the Commissioner of each use of an unauthorised restrictive practice.
