Compliance and enforcement actions

On 11 August 2023, a compliance notice was issued to Jane’s Care Pty Ltd under section 73ZM of the National Disability Insurance Scheme Act 2013. The notices requires Jane’s Care Pty Ltd to take certain actions in relation to breaches of: 

• the National Disability Insurance Scheme (Provider Registration and Practice Standards) Rules 2018, specifically the Practice Standards relating to:
  • Use of Restrictive Practices
  • Behaviour Support
  • Risk Management
  • Administration of Medicines
• the National Disability Insurance Scheme (Restrictive Practices and Behaviour Support) Rules 2018 (Behaviour Support Rules), specifically the Behaviour Support Rules relating to:
  • 10 - Use of a regulated restrictive practice in accordance with a behaviour support plan
  • 12 - Use of a regulated restrictive practice other than in accordance with behaviour support plan or State or Territory authorisation
  • 15 - Record keeping
  • 22 - Review of comprehensive behaviour support plans containing a regulated restrictive practice.
