Compliance and enforcement actions

On 29 September 2023, a compliance notice was issued to Evolution Support Services Pty Ltd under section 73ZM of the National Disability Insurance Scheme Act 2013. The notices requires Evolution Support Services Pty Ltd to take certain action in order to address possible non-compliance with:

National Disability Insurance Scheme (Restrictive Practices and Behaviour Support) Rules 2018, relating to:        

• Prohibited practices
• Unauthorised restrictive practices
• National Disability Insurance Scheme (Incident Management and Reportable Incident) Rules 2018
• National Disability Insurance Scheme (Complaints Management and Resolution) Rules 2018
• National Disability Insurance Scheme (Code of Conduct) Rules 2018, and
• National Disability Insurance Scheme (Provider Registration and Practice Standards) Rules 2018 relating to:
• Governance and operational
• Risk management
• Management of medication
• Incident management
• Human resource management

Implementing behaviour support plans
