On 29 May 2026 a Compliance Notice was issued to Empowerment Care Pty Ltd under section 73ZM of the National Disability Insurance Scheme Act 2013 (NDIS Act). The notice requires Empowerment Care Pty Ltd to take certain action to address non-compliance with section 73J of the NDIS Act due to failing to comply with a condition of registration, specifically section 73F(2)(b), a condition that the person comply with the NDIS Code of Conduct rules and section 73F(2)(c), all applicable standards and other requirements of the NDIS Practice Standards.
The compliance notice relates to NDIS Code of Conduct Rules relating to a requirement that a “Code-covered person must provide supports and services in a safe and competent manner, with care and skill” and “In providing supports or services a code covered person must: act with integrity, honesty and transparency”, and to the NDIS (Provider Registration and Practice Standards) Rules relating to responsive support provisions “Each participant can access responsive, timely, competent and appropriate supports to meet their needs, desired outcomes and goals”, “Each participant’s support needs are met by workers who are competent in relation to their role, hold relevant qualifications and have relevant expertise and experience to provide person-centred support” and “Each participant experiences a planned and coordinated transition to or from the provider”.
