Compliance and enforcement actions

On 7 April 2025 a permanent banning order was made under 73ZN(2)(a)(iii) of the NDIS Act of the National Disability Insurance Scheme Act 2013. The banning order permanently prohibits Carla Judith Smith from: 

1. Being engaged, or otherwise employed, in any role where you are solely responsible for the provision of NDIS supports or services to NDIS participants; and
2. Having unsupervised contact with NDIS participants as part of the provision of NDIS supports or services. 

In this instance: 

3. Contact includes physical contact, face to face contact, oral communication, written communication and electronic communication; and
4. Supervision means direct and in-person observation. 

The banning order is effective from 5:00pm ACST on 24 April 2025, across all States and Territories of Australia.
