Privacy Notice and Agreement for Closed-Circuit Television (CCTV)

Purpose

This Privacy Collection Notice outlines how we manage personal information collected by closed-circuit television (CCTV) and should be read alongside our Privacy policy.

The NDIS Quality and Safeguards Commission (NDIS Commission, we or our) has various shared and separate office locations across Australia containing CCTV. Our office are accessible by members of the public and staff. 

We may collect, use and disclose your personal information, including CCTV recordings/images in accordance with the Privacy Act 1988 (Cth) (Privacy Act), the National Disability Insurance Scheme Act 2013 (Cth) (NDIS Act) and state and territory workplace surveillance laws.

Why is your personal information being collected?

The NDIS Commission collects personal information through CCTV: 

  • to provide services in an environment that is safe and secure for staff and other visitors
  • for recording details of access to the NDIS Commission’s premises, including the identity of individuals and the time of access
  • for planning, prevention, response or recovery from a serious incident or crisis
  • for investigative or legal purposes, including for investigations in accordance with laws, policies and procedures, and
  • to protect and minimise risk of access by unauthorised persons. 

What personal information is being collected?

The NDIS Commission collects personal information through CCTV when an individual enters the premises. This includes, but is not limited to: the carpark, reception area, interview rooms and office space. 

We do not use facial recognition through CCTV.

How do we collect personal information?

Your personal information may be collected when you enter the NDIS Commission carpark (depending on the location), the office lift, or an office at our various locations.

In addition to this notice, we display CCTV signage at NDIS Commission office locations.

Who will the NDIS Commission disclose your personal information to? 

The NDIS Commission may share your personal information, including CCTV footage or images to our Security team, and/or partnered third-party security contractors responsible for providing security services. We may also disclose personal information to Commonwealth, State and Territory enforcement agencies, or where we are authorised or required by law, including by the NDIS Act.  

Overseas disclosure of your personal information 

We do not usually disclose personal information to overseas parties. The NDIS Commission will update our Privacy policy if this changes and we will continue to comply with our privacy obligations.

By entering NDIS Commission premises, you consent to the NDIS Commission collecting and handling your personal information (including sensitive information) in accordance with this Privacy Collection Notice.
