Statement in response to Federal Court matter

The Commission was the subject of an article in The Saturday Paper on 25 November 2023, which focused on a staffing matter currently before the Federal Court.

Interim suppression orders have previously been in place. The Court has ordered these be lifted from 9.30am on 8 December 2023. It is important to note that the matter has yet to be finalised by the Court and much of the information filed by the Applicant is disputed by the Commission.

The Commission does not comment on individual staffing matters out of respect for the Court proceedings and the privacy and wellbeing of Commission staff. Our focus is on supporting Commission staff who continue to be impacted by these proceedings.

While some documents seek to traverse the regulatory actions and decisions of the Commission, the appropriate forum to explore this is the independent review being conducted by the Hon Jennifer Boland AM (Boland Review).

The Commission assures all NDIS participants, their families and supporters that we remain committed to safeguarding participants and delivering positive outcomes for people with disability.

Update - 4 January 2024

Dr Chan and the Commission have mediated and reached a mutually acceptable outcome resulting in the suspension being lifted and the Federal Court proceedings being discontinued.

The Commission acknowledges the impact of this process and any distress that may have been caused.
