Compliance and enforcement actions

On 10 December 2025, NDIS Provider Comfort and Care Respite Pty Ltd was issued with a compliance notice under section 73ZM(1)(b) of the National Disability Insurance Scheme Act 2013 (NDIS Act).

Comfort and Care Respite Pty Ltd is required to take action to address potential non-compliance, including obtaining and lodging restrictive practice authorisation and lodging reportable incidents for the use of unauthorised restrictive practices.

The compliance notice is issued on the basis that a delegate of the Commissioner is aware of information that suggests that Comfort and Care Respite Pty Ltd may be contravening section 73J of the NDIS Act, by allegedly failing to comply with conditions of registration relating to obtaining restrictive practice authorisation and the notification of reportable incidents for the use of unauthorised restrictive practices.
